BreathHoldWork App – Terms of Service

These Terms of Service ("Terms") govern your use of the BreathHoldWork® iOS app ("the App") and related services. By using the App, you agree to these Terms.

1. The App

BreathHoldWork® is a practice instrument for breath-holding training. The App provides Foundation Mode, free to use, with a 10-level guided progression, timers, and audio cues. Advanced Practice is unlocked via BHW Premium subscription, or via a separately-issued activation code.

2. BHW Premium Subscription

Pricing:

• Monthly: $9.99 USD per month
• Yearly: $79.00 USD per year, with a 7-day free trial for new subscribers

Prices may vary by region. The price shown at the time of purchase is the price you pay.

Auto-renewal: Your BHW Premium subscription auto-renews at the end of each billing period at the same price unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID account at confirmation of purchase and at each renewal.

Free trial: If you start with the yearly tier, your 7-day free trial begins immediately. You will not be charged during the trial. After 7 days, your Apple ID will be charged $79.00 for one year of BHW Premium unless you cancel before the trial ends. Cancel anytime during the trial in iPhone Settings → [Your Name] → Subscriptions — no charge if cancelled before the trial ends.

Cancellation: Manage or cancel your subscription anytime in iPhone Settings → [Your Name] → Subscriptions. Cancellation prevents future renewals; you retain access through the end of the current paid period.

Refunds: Refund requests are handled by Apple, not by BreathHoldWork. To request a refund, visit https://reportaproblem.apple.com or contact Apple Support directly.

Restoring purchases: If you switch devices or reinstall the App, use the Restore Purchases option on the paywall screen to restore your BHW Premium subscription. The restore uses your Apple ID — sign into the App Store with the Apple ID that purchased the subscription.

3. Activation Codes

Activation codes are issued through other channels separate from in-app subscriptions. If you have a valid activation code, enter it in the App's activation field to unlock Advanced Practice. Activation codes do not require an in-app subscription, grant access for the duration specified by the issuer, are non-transferable, and may be subject to additional terms by the channel that issued them. 4. Acceptable Use

You agree not to reverse-engineer, decompile, or disassemble the App; use the App in any manner that could damage or impair other users' use of it; attempt to bypass the subscription or activation systems; or share your subscription credentials or activation codes in violation of the issuing channel's terms.

5. Health and Safety

BreathHoldWork involves voluntary apnea (breath-holding), which is a physiological stressor that carries real risk if practiced incorrectly. By using the App, you acknowledge:

• The App is a practice support tool, not a substitute for qualified instruction
• The App does not provide medical advice or diagnostic services
• Do NOT use breath-holding training in water or in any situation where loss of consciousness could result in injury or death
• Do NOT use the App if you have an underlying medical condition that contraindicates apnea training, including cardiovascular disease, uncontrolled hypertension, seizure disorders, pregnancy, or recent surgery
• Consult a qualified healthcare provider before using the App if in doubt

You assume all risk associated with breath-holding practice. To the maximum extent permitted by law, BreathHoldWork disclaims all liability for any injury, illness, or harm arising from use of the App.

6. Intellectual Property

BreathHoldWork®, the BHW logo, the method, and all App content are owned by BreathHoldWork and protected by copyright, trademark, and other intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal practice. You may not redistribute, copy, or commercially exploit any part of the App or its content without written permission.

7. Termination

We may suspend or terminate your access to the App if you violate these Terms. Termination of your subscription does not entitle you to a refund for the unused portion of the current billing period. You may stop using the App at any time and cancel your subscription via Apple as described above.

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, BreathHoldWork's total liability for any claim arising from or related to the App is limited to the amount you paid for the App in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages — including lost data, lost profits, or any harm arising from breath-holding practice — even if advised of the possibility.

10. Changes to These Terms

We may update these Terms. When we do, we will update the revision date above. Continued use of the App after a change constitutes acceptance of the updated Terms. Material changes will be communicated via the App.
