RELEASE OF LIABILITY AND INFORMED CONSENT 

Because physical exertion can be strenuous and subject to risk of serious injury, BreathHoldWork L.L.C. urges you to obtain a physical examination from a doctor before participating in any physical activity. 

This is a legally binding Release, Waiver, Discharge, and Covenant Not to Sue (collectively, “Release”),  made voluntarily by me, the registering party, on my own behalf and on behalf of my heirs,  executors, administrators, legal representatives and assigns. 

This release is entered into, voluntarily and without coercion, between the registering party and BreathHoldWork  L.L.C., its officers, subsidiaries, affiliates, and executors. The registering party hereby acknowledges that the  following was explained to me, and/or I agree to the following: 

I understand and am aware that natural movement and breath-holding practices include training the capacities of, but not limited to, walking, running, jumping, balancing, moving on all fours, climbing, lifting, carrying, throwing and catching heavy objects, swimming, and self-defense training and other various outdoor fitness activities including the use of equipment, in the outdoors, and that such physical activities are potentially hazardous activities. I also understand that outdoor exercise and fitness activities involve a risk of injury and even death and that I am voluntarily participating in these activities and using equipment and facilities with the knowledge of the dangers involved. I hereby agree to expressly assume and accept all and any risks of injury or death. 

I understand and am aware that breathwork and breath-holding involve all manners of breathing and breath retention. I am voluntarily participating in these activities with knowledge of the danger involved. I hereby agree to and expressly assume and accept all risks of injury or death.

I understand that I should never practice BreathHoldWork on my own while immersed in water unless under the supervision of a person qualified to respond in an emergency.

I am aware that I have the right to request advice from any of the BreathHoldWork staff at any time regarding the activities and exercises being undertaken and, but not exclusively, their suitability for me, with particular regard to my health and training attire. If I choose not to take advice or disregard any advice given, I do so voluntarily and accept liability for all resulting injuries or damage. 

I acknowledge that the BreathHoldWork  Staff members are not medical or mental health professionals and that all advice given is just that, advice, not fact. I acknowledge that it is up to me to discern what is right for me and to take appropriate action. I release Erwan Le Corre, BreathHoldWork LLC, and its subsidiaries, employees, and affiliates from any actions that might arise from following the advice given at this training event. 

I acknowledge that I have either had a physical examination and been given my doctor's permission to participate or that I have decided to participate in an activity and use equipment and machinery without the approval of my doctor. I do hereby assume all responsibility for my participation and activities and for utilizing equipment in my activities. 

I hereby state that I will immediately report any symptoms, such as fatigue, shortness of breath, chest discomfort, or any pain or discomfort, that occur during my participation in the BreathHoldWork training event for my safety and benefit. I take full responsibility for stopping an activity myself if it becomes painful or hazardous to my health. 

I understand that BreathHoldWork does not accept responsibility for lost, stolen, or damaged personal property or for personal property left in rooms, tents, cars, or anywhere during the training events.

I understand that this release is intended to be as broad and inclusive as permitted by law. If any portion of this release from liability is deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect, and the offending provision or provisions shall be severed herefrom. 

I understand that no portion of any BreathHoldWork retreat is refundable or transferable. 

By purchasing my event registration, I acknowledge that I understand its content and that this release cannot be modified orally. 

I further agree that any controversy or claim arising out of my in a BreathHoldWork training event that cannot be resolved amicably will be brought within the applicable statutes of limitation.

In consideration of being allowed to participate in the activities and programs, I hereby release and covenant not to sue Erwan Le Corre, BreathHoldWork LLC, or its officers, directors, shareholders,  employees, agents, and contractors from any and all present and future claims resulting from ordinary negligence, for personal injury, or death arising as a result of participating in the activities and/or program(s) of BreathHoldWork, as a result of my participation in BreathHoldWork and use of any equipment and or facilities, and as a result of engaging in any activities incidental thereto, wherever, whenever, or however the same may occur. By purchasing a registration to an event, I hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, which may be made by my heirs, executors, administrators, legal representatives, assigns, or me. 

I HEREBY AFFIRM THAT I HAVE READ AND FULLY UNDERSTAND THE ABOVE STATEMENTS.
